1. Acceptance of Terms

By accessing and using ScrapeScorpion ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

ScrapeScorpion is a web scraping platform that allows users to extract business information from Google Maps and other sources. The Service provides tools for collecting business leads, contact information, ratings, reviews, and other publicly available data.

3. User Accounts

3.1. You must create an account to use certain features of the Service.

3.2. You are responsible for maintaining the confidentiality of your account credentials.

3.3. You agree to provide accurate, current, and complete information during registration.

3.4. You are responsible for all activities that occur under your account.

3.5. You must notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Payment

4.1. Free Trial: Users may use the Service with limited features (10 leads per job) at no cost.

4.2. Pro Plan: $9.99/month - Includes unlimited lead viewing, full export capabilities, and job history.

4.3. Expert Plan: $19.99/month - Includes all Pro features plus advanced analytics, scheduled reports, PDF exports, and the ability to run up to 3 jobs simultaneously.

4.4. Subscriptions are billed monthly in advance.

4.5. All payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service.

4.6. Refund Policy: All subscription fees are non-refundable. All sales are final. We do not provide refunds or credits for partial months of service, unused time, or cancellation of your subscription. This policy applies to all subscription plans (Pro and Expert).

4.7. We reserve the right to change pricing with 30 days notice to existing subscribers.

4.8. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds will be issued for the remaining time in your billing period.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the Service to violate any applicable laws or regulations
Scrape data in violation of Google Maps Terms of Service or any other third-party terms
Use the Service to collect personal information without consent
Use the Service for spam, harassment, or any malicious purposes
Attempt to reverse engineer, decompile, or disassemble the Service
Interfere with or disrupt the Service or servers
Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce
Share your account credentials with others
Resell or redistribute scraped data without proper authorization

6. Data and Content

6.1. You retain ownership of any data you scrape using the Service.

6.2. You are solely responsible for ensuring your use of scraped data complies with applicable laws, including data protection and privacy laws.

6.3. We do not claim ownership of any data you collect through the Service.

6.4. You grant us a license to store and process your data solely for the purpose of providing the Service.

6.5. You are responsible for backing up your data. We are not liable for any data loss.

7. Intellectual Property

7.1. The Service, including its original content, features, and functionality, is owned by ScrapeScorpion and protected by international copyright, trademark, and other intellectual property laws.

7.2. Our trademarks and trade dress may not be used without our prior written consent.

7.3. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Limitation of Liability

8.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

8.2. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.3. We are not responsible for the accuracy, completeness, or legality of data scraped through the Service.

8.4. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

8.5. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless ScrapeScorpion, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or violation of any third-party rights.

10. Termination

10.1. We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10.2. You may terminate your account at any time by canceling your subscription and contacting us.

10.3. Upon termination, your right to use the Service will immediately cease.

10.4. We may delete your account and data after a reasonable period following termination.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the appropriate courts of the United States.
